CONSENSUAL SM DOES NOT EQUAL ABUSE SAYS OREGON APPEALS COURTThe Court of Appeals in Oregon issued a ruling on July 15, 1998 in a case involving SM activity which has some good language for SM players. The case is Boldt v. Boldt, Case # 95-DR-0441, CA A 99286. In this case a couple who met via mail had been together for about 4 years. The wife was from Russia and had moved to the US to marry her husband. Both of the parties conceded that they had a D/s relationship in which the husband was the Master and the woman, the slave. In November 1996 the parties had a situation where the husband was unhappy that the wife did not join him on a weekend trip. When he returned home, he was withdrawn. The wife asked for forgiveness, describing herself as "a bad slave girl" and suggesting a punishment. Husband thereafter hit her with a belt across the buttocks 5 times. Afterwards, everything returned to normal and the parties were happy again. No other such punishment happened after that date. In April of 1997 the wife sought a restraining order on the last possible day in relation to the events of that day in November 1996. The court issued the order. The husband appealed. On appeal the Court ruled that certain elements of the law allowing for restraining orders had not been met as their was no evidence presented of a present danger of further abuse. The Court notes in the appellate decision that it needn't reach the question of "whether and under what circumstances [the law in question] reaches pain-inflicting activity engaged in by competent, consenting adults" and then goes on to note that the law certainly doesn't contemplate such contact sports as boxing and football and indicates that trial courts need to look at the issues of consent, agreement and/or mutuality with particular care in domestic situations. However, the Court further states that "we are not prepared to declare that whenever competent adults agree to engage in conduct that involves inflicting pain, the behavior necessarily constitutes abuse......"
